FIRST CAST ENTERTAINMENT PRIVACY POLICY

1. General

This First Cast Entertainment Privacy Policy ("Privacy Policy") applies to the First Cast Entertainment, LLC ("FirstCast") website located at http://supportamericaunited.com (the "Website") which is owned and operated by FirstCast. FirstCast respects the privacy of its users whether they use the Website to: (a) email friends a link to the Website; (b) contact FirstCast to request additional information about USAA Presents "America United: In Support of Our Troops"; (c) submit their email address to receive email updates about the Website and USAA Presents "America United: In Support of Our Troops"; (d) email FirstCast if they are experiencing technical difficulties with the Website; (e) donate money to a general fund or sponsored charities; (f) submit a message of hope and key words to the message of hope tribute page; (g) email a friend a message of hope; (h) submit a photo and text to the military hall of fame; (i) email a friend their submission to the military hall of fame along with a message; (j) send a friend an email about the sweepstakes contest; (k) email a friend video clips; (l) participate in a sweepstakes; or (m) simply view the Website. The Privacy Policy is designed to inform you, as a user of the Website, about the types of information that FirstCast may gather about or collect from you in connection with your use of the Website. It also is intended to explain the conditions under which FirstCast uses and discloses that information, and your rights in relation to that information.

A. The Entire Privacy Policy

This Privacy Policy, together with the Terms of Use Agreement located at http://supportamericaunited.com/terms_of_use.php, and the First Cast Entertainment DMCA Notice located at http://www.supportamericaunited.com/dcma.php, both of which are incorporated herein, constitute the entire agreement between you and FirstCast regarding your use of the Website, FirstCast's collection of information on the Website and FirstCast's use of such information. For the avoidance of doubt, in the event of a conflict between this Privacy Policy and the Terms of Use Agreement or other terms and conditions posted on the Website, the Terms of Use Agreement will control.

B. Changes to the Privacy Policy

Changes to this Privacy Policy are discussed at the end of this document. Each time you use the Website, however, the current version of this Privacy Policy will apply. Accordingly, we ask that you regularly review this Privacy Policy, and each time you use the Website you should check the date of this Privacy Policy (which appears at the end of this document) and review any changes since the last time you used the site.

2. Children

The Website is not intended for children under 13 years of age. FirstCast does not knowingly collect personal information from children under 13.

3. Gathering, Use and Disclosure of Non-Personally-Identifying Information

A. Users of the Website Generally

"Non-Personally-Identifying Information" is information that, without the aid of additional information, cannot be directly associated with a specific person or entity.

"Personally-Identifying Information," by contrast, is information such as a name or email address that, without more, can be directly associated with a specific person or entity.

(i) Web browsers

Like most website operators, FirstCast gathers from users of the Website Non-Personally-Identifying Information of the sort that Web browsers, depending on their settings, may make available. That information includes the user's Internet Protocol ("IP") address, the number of times a user visits the Website, accesses, operating system and browser type, screen resolution, and the locations of the Web pages the user views right before arriving at, while navigating and immediately after leaving the Website.

(ii) Other Collection of Non-Personally-Identifying Information

FirstCast may also collect information about the amount of time a user spends on a particular Website Page.

(iii) Use of Non-Personally-Identifying Information

FirstCast analyzes Non-Personally-Identifying Information gathered from users of the Website to help FirstCast better understand how the Website is being used. By identifying patterns and trends in usage, FirstCast is able to better design the Website to improve users' experiences, both in terms of content and ease of use. From time to time, FirstCast may also release the Non-Personally-Identifying Information gathered from Website users in the aggregate, such as by publishing a report on trends in the usage of the Website.

B. Web Cookies

A "Web Cookie" is a string of information that a website stores on a user's computer, and that the user's browser provides to the website each time the user submits a query to the site. FirstCast uses Web Cookies to track unique visitors and the pages that users visit during each Website session, both to help FirstCast improve users' experiences and to help FirstCast understand how the Website is being used.

As with other Non-Personally-Identifying Information gathered from users of the Website, FirstCast analyzes and discloses in aggregated form information gathered using Web Cookies, so as to help FirstCast, its partners and others better understand how the Website is being used. FirstCast does not attempt to link information gathered using Web Cookies to Personally-Identifying Information.

FIRSTCAST USERS WHO DO NOT WISH TO HAVE WEB COOKIES PLACED ON THEIR COMPUTERS SHOULD SET THEIR BROWSERS TO REFUSE WEB COOKIES BEFORE ACCESSING THE WEBSITE, WITH THE UNDERSTANDING THAT CERTAIN FEATURES OF THE WEBSITE MAY NOT FUNCTION PROPERLY WITHOUT THE AID OF WEB COOKIES. WEBSITE USERS WHO REFUSE WEB COOKIES ASSUME ALL RESPONSIBILITY FOR ANY RESULTING LOSS OF FUNCTIONALITY.

C. Pixel Tags

In our emails to you, we may use "pixel tags" to determine if your email software or service can display html-formatted email (this helps FirstCast optimize the size of our email messages and conserve bandwidth).

4. Collection, Use and Disclosure of Personally-Identifying Information

A. Website Registration and Making Contributions to the Website

As defined above, Personally-Identifying Information is information that can be directly associated with a specific person or entity. FirstCast collects a range of Personally-Identifying Information from and about Website users. Much of the Personally-Identifying Information collected by FirstCast about users is information provided by users themselves. For example, when users register with the Website, each user will provide their first name, last name, gender, password, email address, street address, city, state, zip code, telephone number and cell phone number. Each user may also provide additional Personally-Identifying Information to FirstCast in the text of an email he or she sends by means of the Website: (1) to FirstCast to request additional information about USAA Presents "America United: In Support of Our Troops"; (2) to FirstCast to report technical difficulties with the Website; (3) to a friend when a user sends a friend a message of hope; (4) to a friend when a user sends the friend the user's submission to the military hall of fame; or (5) to a friend when a user sends the friend an email about the sweepstakes contest or a link to a video clip. Each user may also provide Personally-Identifying Information to FirstCast when they submit a posting to the message of hope page or submit a photo and text to the military hall of fame page.

Users of the Website are under no obligation to provide FirstCast with Personally-Identifying Information of any kind, with the caveat that a user's refusal to do so may prevent the user from using certain Website features.

BY USING THE WEBSITE, YOU CONSENT TO THE USE AND DISCLOSURE OF YOUR PERSONALLY-IDENTIFYING INFORMATION AS DESCRIBED IN THIS "COLLECTION, USE AND DISCLOSURE OF PERSONALLY-IDENTIFYING INFORMATION" SECTION.

B. On-line Forums

As described above, certain Personally-Identifying Information collected from users is disclosed as a matter of course as a result of those users' use of the Website. Because of the international scope of the Internet, users around the world can view your postings on the Website. We expect that you will use caution and common sense when using the Website. USERS ASSUME ALL RESPONSIBILITY FOR ANY LOSS OF PRIVACY OR OTHER HARM RESULTING FROM THEIR VOLUNTARY DISCLOSURE OF PERSONALLY-IDENTIFYING INFORMATION.

C. Making Submissions Anonymous

Users may make their submissions to the messages of hope tribute page and military hall of fame page anonymous by clicking to check the box to indicate that you want to make your submission anonymous. If you check the box to make your submission to the messages of hope page anonymous, then your name, city of residence and state of residence will not be posted along with your message. If you check the box to make your submission to the military hall of fame page anonymous, then your first name and first initial of your last name will not be posted along with your posting. Once you submit a message to the messages of hope tribute page or the military hall of fame page, you cannot then go back and change whether the message is anonymous or public.

D. DMCA Infringement Notifications, Notices of Violations of Website Terms of Service and Other Communications Directed to FirstCast

By submitting a Copyright Infringement Notification or other communication (including communications about content stored on or transmitted through the Website) to FirstCast, you consent to have such communication forwarded to the person or entity who stored or transmitted the content addressed by your communication, in order to facilitate a prompt resolution. For Notices of Violations of Website Terms of Service or other communications (but not DMCA Infringement Notifications), upon request FirstCast will edit out your name and contact information. However, DMCA Infringement Notifications (including any Personally-Identifying Information set forth in the Notifications) will be forwarded as submitted to FirstCast without any deletions.

E. Our Security Measures

FirstCast takes reasonable precautions to protect the security of users' Personally-Identifying Information. FirstCast has physical, electronic, and managerial procedures to help safeguard, prevent unauthorized access, maintain data security, and correctly use your information. However, neither people nor security systems are foolproof, including encryption systems. Therefore, while FirstCast uses reasonable efforts to protect your Personally-Identifying Information, FirstCast cannot guarantee its absolute security.

F. Information Security Policy

In the event of a security breach, FirstCast will notify you at the most current email address that you have provided to us. It is therefore extremely important that you update us if you change email addresses and that you make sure that we consistently have the most current email address for you on file. Unless a different time period is mandated by the laws of the state in which you live, any security breach notice will be sent to you in the most expedient time possible following our discovery or notice of a security breach, and without unreasonable delay, subject to any determination by a law enforcement agency that notice would impede a criminal investigation, in which case the notice will be sent once the agency determines that notice will not compromise the investigation. G. Surveys

From time to time, FirstCast may also ask Website users to participate in surveys designed to help FirstCast improve the Website. Any Personally-Identifying Information provided to FirstCast in connection with any survey will be used only in relation to that survey, and will be disclosed to third parties not bound by this Privacy Policy only in Non-Personally-Identifying form.

H. Website Updates

If users submit their email addresses to receive updates about the site, FirstCast will email users about changes to the Website. If a user wishes to opt-out of receiving such emails at any time after signing up for the Website update service, they may do so by sending FirstCast an email at InfoAmericaUnited@gmail.com.

I. Email to Friends Feature

If you choose to use our invitation service to tell a friend about this Website or any of the features, programs or postings on the website (including without limitation the sweepstakes program, any materials you submit to the military hall of fame and any messages on the messages of hope tribute page), we will ask you for your name and email address, and your friend's name and email address. We will automatically send your friend a one-time email from your email address inviting him or her to visit the site. If your friend replies to this email, the response will be sent to your email address. FirstCast stores your friend's name and email address only for the purposes of sending this one-time email. Your friend may contact us at InfoAmericaUnited@gmail.com to request that we remove this information from our database.

J. Other Disclosures

As described in the previous sections titled "Collection, Use and Disclosure of Personally-Identifying Information," users may, at their option, disclose their own Personally-Identifying Information by any means they choose, including without limitation through submitting photo descriptions and making contributions to forums. FirstCast, will disclose Personally-Identifying Information to FirstCast employees, contractors, affiliates, partners, vendors and suppliers who process Personally-Identifying Information on FirstCast's behalf or participate with FirstCast in the provision or operation of the Website or the services provided by means of the Website. FirstCast also will disclose Personally-Identifying Information under the following circumstances:

• By Law or to Protect Rights - FirstCast discloses Personally-Identifying Information: (1) when required to do so by law, or in response to a subpoena or court order; (2) when FirstCast believes in its sole discretion that disclosure is reasonably necessary to protect against fraud, to protect the property or rights of FirstCast, other users, third parties or the public at large; (3) if FirstCast believes that you have abused the service by using it to attack other systems or to gain unauthorized access to any other system, to engage in spamming or otherwise to violate applicable laws; and (4) to comply with FirstCast's policies.
• Marketing Communications - If users opt-in to receive FirstCast and third party marketing materials upon registration, FirstCast will email users about products and services that FirstCast believes may be of interest to them. FirstCast also will provide users' email information to third parties, so that those third parties may directly contact users about additional products and services. If a user wishes to opt-out of having their email information provided to third parties at any time after registration, they may do so by sending FirstCast an email at InfoAmericaUnited@gmail.com. Even after opting-out, a user may continue to receive marketing emails from third parties to whom FirstCast already has provided the user's email information. Users will be responsible for directly contacting such third parties to request cessation of further marketing emails.
• Business Transfers; Bankruptcy - FirstCast reserves the right to transfer all Personally-Identifying Information in its possession to a successor organization in the event of a merger, acquisition, or bankruptcy or other sale of all or a portion of FirstCast's assets. Other than to the extent ordered by a bankruptcy or other court, the use and disclosure of all transferred Personally-Identifying Information will be subject to this Privacy Policy, or to a new privacy policy if you are given notice of that new privacy policy and affirmatively opt-in to accept it. Personally-Identifying Information submitted or collected after a transfer, however, may be subject to a new privacy policy adopted by the successor organization.

5. Collection and Use of Information by Third Parties

A. Generally

Third parties are under no obligation to comply with this Privacy Policy with respect to Personally-Identifying Information that users directly provide to those third parties or that those third parties collect for themselves. FirstCast neither owns nor controls the third-party websites accessible through the Website. FirstCast does not own or control Dowd Agency. Thus, this Privacy Policy does not apply to information contained in press inquiries submitted to Jim Dowd of the Dowd Agency or information provided to third party sites or gathered by the third parties that operate them. Before visiting or contacting a third-party site or service, whether by means of a link on the Website or otherwise, and before providing any Personally-Identifying Information to any third party, users should inform themselves of the privacy policies and practices (if any) of the third party, and, if appropriate, should take steps necessary to protect their privacy pursuant to such policies.

B. Links, Advertisers and Third Parties

Some parts of the Website may link to the websites of unrelated third party companies that offer you the option to share your personal information with them. FirstCast will not share your personally identifiable information with those third party companies or with the Dowd Agency. It will only be shared if you choose to provide it to those third party companies.

FirstCast does not control the Dowd Agency or those sites or their privacy practices, which may differ from ours. FirstCast does not endorse or make any representations about any third parties or third party sites that may be accessible through the Website. FirstCast encourages you to review the privacy policy of any other website before submitting your personal information. The personal data you choose to give to unrelated third parties is covered by their privacy policies, not the FirstCast Privacy Policy. Some third party companies may choose to share their personal data with FirstCast; that sharing is governed by that third party company's privacy policy.

FirstCast may, in its sole discretion, change this Privacy Policy from time to time. Any and all changes to FirstCast's Privacy Policy will also be reflected on this page. Unless FirstCast obtains your express consent, any revised Privacy Policy will apply only to information collected after such time as the revised Privacy Policy takes effect, and not to information collected under any earlier Privacy Policies. First cast entertainment TERMS OF USE AGREEMENT

This First Cast Entertainment, LLC Terms of Use Agreement ("Agreement") constitutes a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and First Cast Entertainment, LLC ("FirstCast"), concerning your access to and use of the FirstCast website located at: http://www.supportamericaunited.com (the "Website"), and the FirstCast Services (as defined below). You may use the Website in two ways: (a) you can simply view the Website and not participate in any interactive programs; or (b) you may become a registered user and participate in all of the interactive features relating to the television special "America United: In Support of Our Troops" offered by FirstCast from time to time in connection with the Website (such as posting, searching for and reviewing certain messages of hope and keywords, posting photos and personalized messages in the military hall of fame, making donations to charities, emailing various postings, messages of hope and military hall of fame messages to friends, participating in a sweepstakes and downloading PDFs and banners) (collectively, the "FirstCast Services").

This Agreement together with the First Cast Entertainment, LLC Privacy Policy ("Privacy Policy") located at http://supportamericaunited.com/privacy_policy.php and the First Cast Entertainment, LLC DMCA Notice ("DMCA Notice") located at http://www.supportamericaunited.com/dcma.php, which are incorporated by reference herein, constitute the entire Agreement between you and FirstCast regarding your use of the Website.

In order to become a registered user you must first register with FirstCast through FirstCast's online registration process at http://www.supportamericaunited.com/register.php. Regardless of how you decide to use the Website and the FirstCast Services, your conduct on the Website is governed by this Agreement and FirstCast's Privacy Policy located at http://supportamericaunited.com/privacy_policy.php. The FirstCast Services are hosted in the United States.

1.                  Eligibility. FirstCast will only knowingly provide FirstCast Services to parties who are 13 years of age or older. The FirstCast Services are not intended for parties who are under the age of 13. By using the FirstCast Services, you represent and warrant that: (a) all information you submit is truthful and accurate; (b) you will maintain the accuracy of such information; (c) you are 13 years of age or older; and (d) your use of the FirstCast Services does not violate any applicable law or regulation. FirstCast may terminate this Agreement and your use of the Website without warning if FirstCast, in its sole discretion, believes that you are under 13 years of age. You further represent and warrant that you will comply with all local rules regarding online conduct and acceptable Contributions (as defined below in Section 2). Only United States residents may become registered users of the Website.

2.                  User Representations and Warranties. You are entirely responsible for the content of, and any harm resulting from, your postings to forums, chatrooms and blogs and all other submissions to the Website including without limitation any emails, photos, surveys or feedback (collectively, "Contribution"). When you create or make available a Contribution, you thereby represent and warrant that:

(a) the creation, distribution, transmission, public display and performance, accessing, downloading and copying of your Contribution does not and will not infringe the proprietary rights, including but not limited to the copyright, patent, trademark or trade secret rights of any third party;

(b) you have fully complied with any third-party licenses relating to your Contribution, and have done all things necessary to successfully pass through to viewers any required terms;

(c) your Contribution does not contain any viruses, worms, Trojan horses, malicious code or other harmful or destructive content;

(d) your Contribution is not obscene, lewd, lascivious, filthy, excessively violent, harassing or otherwise objectionable, libelous or slanderous, does not advocate the violent overthrow of the government of the United States, does not incite, encourage or threaten immediate physical harm against another, does not violate any applicable law, regulation, or rule, and does not violate the privacy or publicity rights of any third party;

(e) your Contribution does not contain material that solicits personal information from anyone under 18 or exploit people under the age of 18 in a sexual or violent manner, and does not violate any federal or state law concerning child pornography or otherwise intended to protect the health or wellbeing of minors;

(f) if your employer has rights to intellectual property you create, you have either (i) received permission from your employer to make available the Contribution, or (ii) secured from your employer a waiver as to all rights in or to your Contribution;

(g) your Contribution does not violate any state or federal law designed to regulate electronic advertising;

(h) your Contribution does not amount to trolling, or the making of controversial statements for the sole purpose of generating responses by others;

(i) your Contribution does not constitute, contain, install or attempt to install or promote spyware, malware or other computer code, whether on FirstCast's or others computers or equipment, designed to enable you or others to gather information about or monitor the online or other activities of another party;

(j) your Contribution does not inundate the Website with communications or other traffic suggesting no serious intent to use the Website for its stated purpose;

(k) your Contribution does not otherwise violate, or link to material that violates, any provision of this Agreement or any applicable law or regulation;

(l) your Contribution does not contain pictures, data, audio or visual files, or any other content that is excessive in size, as determined by FirstCast in its sole discretion; and

(m) you have all rights required to modify or crop any photos that you post to the Website.

3.                  Prohibited Activities. You may not access or use the Website for any purpose other than that for which FirstCast makes it available. Certain activities, even if legal, may violate the common rules of etiquette governing Contributions, as determined by FirstCast in FirstCast's sole discretion. FirstCast reserves the right, in its sole discretion, to investigate and take appropriate legal action against anyone who, in FirstCast's sole discretion, violates this provision. Prohibited activity includes, but is not limited to:

(a)                criminal or tortuous activity, including without limitation child pornography, fraud, trafficking in obscene material, drug dealing, gambling, harassment, stalking, spamming, copyright infringement, patent infringement, or theft of trade secrets;

(b)               advertising to, or solicitation of, any user to buy or sell any products or services;

(c)                transmitting chain letters or junk email to other users;

(d)               using any information obtained from the Website in order to contact, advertise to, solicit, or sell to any user without their prior explicit consent;

(e)                engaging in any automated use of the system, such as using scripts to send comments or messages;

(f)                interfering with, disrupting, or creating an undue burden on the Website or the networks or services connected to the Website;

(g)               attempting to impersonate another user or person or entity;

(h)               using the username of another user;

(i)                 using a false email address;

(j)                 selling or otherwise transferring your profile;

(k)               using any information obtained from the Website in order to harass, abuse, or harm another person;

(l)                 displaying an advertisement, or accepting payment or anything of value from a third person in exchange for your performing any commercial activity on or through the Website on behalf of that person, such as posting blogs or bulletins with a commercial purpose;

(m)             using the Website in a manner inconsistent with any and all applicable laws and regulations;

(n)               providing material support, information or resources (or concealing or disguising the nature, location, source, or ownership of material support, information or resources) to any organization(s) designated by the United States government as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act; and

(o)               using the system to send unsolicited or commercial emails, bulletins, comments or other communications. As a reasonable estimation of such harm, you agree to pay FirstCast $50 for each such unsolicited email or other unsolicited communication you send through the FirstCast Services.

4.                  Grant of License to FirstCast. FirstCast does not claim any ownership rights in the Contributions that you post on or through the FirstCast Services. After making a Contribution to the FirstCast Services, you continue to retain any ownership rights that you may have in your Contributions, subject to the limited license described in this paragraph. By making a Contribution to the Website, you hereby grant to FirstCast a perpetual, non-exclusive, fully-paid, royalty-free, sublicensable worldwide license to use, modify, create derivative works of, publicly perform, publicly display, reproduce, rent, resell and distribute such Contribution in all media now known or hereafter created and in any other manner in FirstCast's sole discretion.

The license you grant to FirstCast is non-exclusive (meaning you are free to license your Contribution to anyone else in addition to FirstCast), fully-paid and royalty-free (meaning that FirstCast is not required to pay you for the use on the FirstCast Services of the Contribution that you submit to the Website), sublicensable (so that FirstCast is able to use its affiliates, subcontractors and other partners such as Internet content delivery networks and wireless carriers to provide the FirstCast Services), and worldwide (because the Internet and the FirstCast Services are global in reach).

5.                  Passwords. When you create an account with the Website, you will be asked to supply a password. You must keep your password confidential, and are responsible for all use of your password and account.

6.                  Intellectual Property Rights. The content on the Website, except for Contributions including without limitation, the text, software, scripts, graphics, photos, sounds, photos, sayings, interactive features and the like ("Materials") and the trademarks, service marks and logos contained therein ("Marks"), are owned by or licensed to FirstCast, subject to copyright and other intellectual property rights under United States and foreign laws and international conventions. Materials on the Website are provided to you AS IS for your information and personal use only and may not be used, copied, reproduced, distributed, transmitted, broadcast, displayed, sold, licensed, or otherwise exploited for any other purposes whatsoever without the prior written consent of the respective owners. FirstCast reserves all rights not expressly granted in and to the Website and the Materials. You agree to not engage in the use, copying, or distribution of any of the Materials other than expressly permitted by FirstCast, including any use, copying, or distribution of third parties' materials obtained through the Website for any commercial purposes. If you download or print a copy of the Materials for personal use, you must retain all copyright and other proprietary notices contained therein. You agree not to circumvent, disable or otherwise interfere with security related features of the Website or features that prevent or restrict use or copying of any Materials or enforce limitations on use of the Website or the Materials therein.

7.                  FirstCast's Right to Manage the Website and Terminate Users.

7.1              FirstCast Website Management. FirstCast reserves the right, but does not have the obligation, to: (a) monitor the Website for violations of this Agreement; (b) take appropriate legal action against anyone who, in FirstCast's sole discretion, violates this Agreement, including without limitation, reporting you to law enforcement authorities; (c) refuse, restrict access to or the availability of, or disable access to (to the extent technologically feasible) or remove any user's Contribution or any portion thereof that may violate this Agreement or any FirstCast policy, in FirstCast's sole discretion; (d) in FirstCast's sole discretion and without limitation, notice or liability to remove from the Website or otherwise disable all files and content that are excessive in size or are in any way burdensome to FirstCast's systems; (e) terminate the accounts of repeat infringers; and (f) to otherwise manage the Website in a manner designed to protect the rights and property of FirstCast and others and to facilitate the proper functioning of the Website..

7.2              FirstCast's Right to Terminate Users. WITHOUT LIMITING ANY OTHER PROVISION OF THIS AGREEMENT, FIRSTCAST RESERVES THE RIGHT TO, IN FIRSTCAST'S SOLE DISCRETION AND WITHOUT NOTICE OR LIABILITY, DENY ACCESS TO AND USE OF THE WEBSITE TO, ANY PERSON FOR ANY REASON OR FOR NO REASON AT ALL, INCLUDING WITHOUT LIMITATION FOR BREACH OF ANY REPRESENTATION, WARRANTY OR COVENANT CONTAINED IN THIS AGREEMENT, OR OF ANY APPLICABLE LAW OR REGULATION.

7.3              Risk of Harm. Please note that there are risks, including but not limited to the risk of physical harm, of dealing with strangers, including persons who may be acting under false pretenses. Please choose carefully the information you post on the Website and that you give to other Website users. You are discouraged from posting the following information on the Website: telephone numbers, street addresses, last names and any photographs containing nudity or obscene, lewd, excessively violent, harassing, sexually explicit or otherwise objectionable matter. Even after your use and participation are terminated, this Agreement will remain in effect, including: Section 1 ("Eligibility"), Section 2 ("User Representations and Warranties"); Section 3 ("Prohibited Activities"); Section 4 ("Grant of License to FirstCast"); Section 5 ("Passwords"); Section 6 ("Intellectual Property Rights"); Section 7 ("FirstCast's Right to Manage the Website and Terminate Users"); Section 8 ("Third Party Websites"); Section 9 ("Term"); Section 10 ("Non-commercial Use by Users"); Section 11 ("Copyright Policy"); Section 12 ("Modifications"); Section 13 ("Disputes Between Users"); Section 14 ("Disputes with FirstCast"); Section 15 ("Disclaimers"); Section 16 ("Limitation on Liability"); Section 17 ("Indemnity") and Section 18 ("Miscellaneous").

10.              Non-commercial Use by Users. The FirstCast Services are for the personal use of users only and may not be used in connection with any commercial endeavors, except those that are specifically endorsed or approved by FirstCast. You shall not do the following without the express written consent of FirstCast: (a) make any unauthorized use of the FirstCast Services, including collecting usernames and/or email address of users by electronic or other means for the purpose of sending unsolicited email; and (b) engage in unauthorized framing of or linking to the Website.

FirstCast will alert all users with whom it maintains email information of such modifications by means of an email to their most recently provided email address. Any and all changes to this Agreement will also be reflected on the Website. You agree to be bound to any changes to this Agreement when you use the FirstCast Services after any such modification is posted. It is therefore important that you regularly review this Agreement and keep your contact information current to ensure you are informed of any changes.

13.              Disputes Between Users. You are solely responsible for your conduct. FirstCast reserves the right, but has no obligation, to monitor disputes between you and other users.

14.              Disputes with FirstCast.

14.1 FirstCast's Right to Injunctive Relief. Notwithstanding the parties' agreement to arbitration, you and FirstCast agree that FirstCast shall have the right to obtain injunctive relief in a court of law to stop or prevent any violation of its intellectual property rights or to protect the Website or FirstCast Services or users of the site or services.

14.2 Choice of Law and Forum. You and FirstCast agree to submit to the exclusive jurisdiction of the state or federal courts located in Los Angeles, California. You and FirstCast agree that any disputes shall be resolved under the substantive law of the state of California (exclusive of its choice of law provisions).

NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, FIRSTCAST'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO $50.

17.              Indemnity. You agree to defend, indemnify and hold FirstCast, its subsidiaries, affiliates and licensors and their respective officers, agents, partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys' fees made by any third party due to or arising out of your Contributions, use of the FirstCast Services in violation of this Agreement and/or arising from a breach of this Agreement and/or any breach of your representations and warranties set forth above and/or if any Contribution that you post on the Website or through the FirstCast Services causes FirstCast to be liable to another.

18.              Miscellaneous.

18.1          Entire Agreement. This Agreement constitutes the entire agreement between you and FirstCast regarding the use of the FirstCast Services and Website.

18.2          Waiver. The failure of FirstCast to exercise or enforce any right or provision of this Agreement shall not operate as a waiver of such right or provision.

18.3          Section Titles. The section titles in this Agreement are for convenience only and have no legal or contractual effect.

18.4          Assignment. You may not assign your rights under this Agreement to any third party; FirstCast may assign its rights under this Agreement without condition.

18.5          Severability. This Agreement operates to the fullest extent permissible by law. If any provision or part of a provision of this Agreement is unlawful, void or unenforceable, that provision or part of the provision is deemed severable from this Agreement and does not affect the validity and enforceability of any remaining provisions.

18.6          Third Party Beneficiaries. This Agreement will be binding upon and will inure to the benefit of the parties' permitted successors and/or assignees.
